Legal Status of Sweetwater Authority

Sweetwater Authority is a Joint Powers Agency formed by an agreement entered into between the South Bay Irrigation District, an irrigation district organized and existing under the Irrigation District Law of the State of California, (Water Code Section 20500 et seq.) and the City of National City, a municipal corporation organized and existing under the laws of the State of California, (Title IV of the Government Code).

The Joint Powers agreement was entered into pursuant to the provisions of Article I, Chapter 5, Division 7, Title of the Government code of the State of California commencing with Government Code Section 6500. The Sweetwater Authority is a separate public entity (Government Code Section 6507), which possesses powers common to both the South Bay Irrigation District and the City of National City "subject only to such restrictions upon the manner of exercising such powers as are imposed upon South Bay Irrigation District in the exercise of similar powers." Thus the powers of the Sweetwater Authority are the powers specified in Section 3 of the Joint Powers Agreement, which shall be exercised in accordance with powers of an irrigation district under the Irrigation District Law.
